1. Definitions
- "Service" — The PrivacyFetch website at privacyfetch.com, the developer API, and any related tools or features.
- "User," "you" — Any person who accesses or uses the Service.
- "Account" — A registered user account on the Service.
- "API" — The PrivacyFetch developer API available at privacyfetch.com/api/v1/.
- "Company data" — Information about companies in the PrivacyFetch directory, derived from publicly available sources.
- "Privacy score" — Our AI-generated assessment of a company's privacy practices.
- "Team" — A group account that allows multiple users to share API access and manage company profiles.
- "We," "us," "PrivacyFetch" — PrivacyFetch, operated from Romania.
2. Acceptance and Eligibility
By accessing or using the Service, you agree to these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Service.
- You must be at least 16 years old to use the Service.
- If you use the Service on behalf of a company or organization, you represent that you have the authority to bind that organization to these terms.
- These terms are governed by Romanian law, with the General Data Protection Regulation (GDPR) as the overriding framework for data protection.
3. Account Registration
- Accounts may be created via email and password, or via OAuth (Google, GitHub, LinkedIn).
- You must provide accurate and complete information.
- You are responsible for maintaining the security of your credentials. Do not share your password or API keys.
- One person, one account. Do not create multiple accounts.
- Notify us promptly at support@privacyfetch.com if you suspect unauthorized access to your account.
4. Description of Service
PrivacyFetch provides:
- A company privacy directory with privacy scores, data practice analysis, and risk signals.
- Privacy policy analysis using AI to extract and score data practices from publicly available policies.
- A developer API for programmatic access to company privacy data.
- Team collaboration features for managing company profiles and API access.
- Company claiming — companies can verify ownership of their directory profile.
- Newsletter and notifications about privacy score changes, policy updates, and new features.
- Breach monitoring — optional alerts when your email appears in a known data breach.
Privacy scores and analyses are generated by AI from publicly available information. They are informational only and do not constitute legal, compliance, or professional advice.
5. Subscriptions and Payment
- The Service offers both free and paid plans. Plan details and pricing are listed on our pricing page.
- Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
- Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds: If you are unsatisfied with a paid plan, contact support@privacyfetch.com within 14 days of purchase for a full refund.
- We may change pricing with at least 30 days notice to active subscribers. If you disagree with a price change, you may cancel before the new price takes effect.
6. API Terms
- API access is subject to rate limits that vary by plan. Current limits are documented in our API documentation.
- The API is provided for legitimate integrations. Fair use applies — the API is not intended for replicating the entire directory.
- API keys are confidential. Do not expose them in client-side code, public repositories, or shared environments.
- Prohibited uses:
- Scraping the entire directory or systematically downloading all company data.
- Circumventing rate limits through multiple accounts, rotating keys, or other means.
- Reselling raw API data without adding substantial value.
- Using the API for any unlawful purpose.
- Attribution: If you publicly display PrivacyFetch data (e.g. in an app or website), you must visibly attribute it to PrivacyFetch with a link to privacyfetch.com.
- We do not guarantee specific uptime or response times. We target high availability but the API is provided "as is."
- We may throttle, suspend, or revoke API access for violation of these terms or for abusive behavior.
7. Company Claims
- Companies listed in the directory may claim their profile to verify ownership and provide updated information.
- By submitting a claim, you represent that you have the authority to act on behalf of the company.
- Verification is performed via email to an address on the company's domain.
- Claimed companies may update factual information about their data practices.
- PrivacyFetch retains full editorial control over privacy scores, analysis, and risk signals. Claiming a profile does not grant the ability to alter or suppress scores.
- You are responsible for the accuracy of any information you submit.
8. User Conduct
You agree not to:
- Misrepresent your identity or authority when using the Service.
- Submit fraudulent company claims.
- Attempt to manipulate, game, or artificially inflate privacy scores.
- Reverse engineer the scoring methodology beyond what is publicly documented.
- Use the Service for any illegal purpose.
- Interfere with the infrastructure, security, or availability of the Service.
- Access the Service through automated means outside of the documented API (scraping, bots, etc.).
- Harass, threaten, or abuse other users or PrivacyFetch staff.
9. Intellectual Property
- The PrivacyFetch platform — including its design, code, scoring methodology, brand, and documentation — is owned by PrivacyFetch.
- Company data in the directory is factual information derived from publicly available sources and does not constitute proprietary content of PrivacyFetch.
- You may not reproduce, distribute, or create derivative works of the platform, its design, or its scoring methodology without prior written permission.
- By submitting information to the Service (e.g. company claim data, profile updates), you grant PrivacyFetch a worldwide, non-exclusive, royalty-free license to use, display, and distribute that information within the directory.
10. Privacy
We process your personal data as described in our Privacy Policy, which forms part of these Terms. Please read it carefully.
11. Disclaimers
- Privacy scores and analyses are informational only and do not constitute legal, compliance, data protection, or professional advice. Do not rely on them as a substitute for qualified legal counsel.
- Scores are generated by AI analysis of publicly available data. While we make reasonable efforts to ensure accuracy, we do not guarantee that all information is current, complete, or error-free.
- Company data may change after our last analysis. The "last analyzed" date on each profile indicates when the analysis was last performed.
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- PrivacyFetch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- Our total aggregate liability for any claim arising from or related to the Service shall not exceed the greater of (a) the total amount you paid to PrivacyFetch in the 12 months preceding the claim, or (b) EUR 100.
- Nothing in these terms excludes or limits liability for: fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable EU or Romanian law.
- If you are a consumer in the EU, your mandatory consumer protection rights under EU law are not affected by these terms.
13. Indemnification
You agree to indemnify and hold harmless PrivacyFetch from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your violation of these terms.
- Your misuse of the Service.
- Your infringement of any third-party rights.
This indemnification does not apply to the extent that the claim arises from PrivacyFetch's own negligence or willful misconduct.
14. Termination
- You may delete your account at any time from your profile settings. Upon deletion, your personal data is handled as described in our Privacy Policy — account deletion cascades to all associated records.
- We may suspend or terminate your account at any time for violation of these terms, with notice where practicable. In cases of severe or repeated violations, we may terminate without prior notice.
- The following sections survive termination: Intellectual Property (Section 9), Disclaimers (Section 11), Limitation of Liability (Section 12), Indemnification (Section 13), Dispute Resolution (Section 15), and any other provisions that by their nature should survive.
15. Dispute Resolution
- These terms are governed by the laws of Romania, without regard to conflict of law principles.
- Any disputes shall be submitted to the exclusive jurisdiction of the courts of Bucharest, Romania.
- If you are a consumer in the EU, you retain the right to bring claims in the courts of your country of residence under Regulation (EU) No 1215/2012.
- EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
16. Changes to These Terms
We may modify these terms from time to time. When we make material changes, we will:
- Notify registered users by email at least 14 days before the changes take effect.
- Update the "Effective" date at the top of this page.
Continued use of the Service after the effective date constitutes acceptance of the updated terms. If you disagree with the changes, you may delete your account before the effective date.
17. Miscellaneous
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- No waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Entire agreement: These terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and PrivacyFetch.
- Assignment: We may assign these terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our consent.
